PLATE Terms of Service

PLATE is not medical advice
Nutrition values are estimates. PLATE is a general wellness tool and is not designed to diagnose, treat or manage any medical condition. Do not use it to calculate medication or insulin doses. If you have any medical condition or a history of disordered eating, PLATE is not suitable for you (see sections 2 and 3).
1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Klyra Innovations Private Limited (“PLATE”, “we”, “us”) and govern your use of the PLATE app, website and related services (the “Service”). By creating an account, subscribing or using the Service, you agree to these Terms and to our Privacy Policy (https://api.plate.klyra.in/legal/privacy). If you do not agree, do not use the Service.
2. Who may use PLATE
PLATE is offered only to generally healthy adults aged 19 through 64 who can enter into a binding agreement and use the service for their own personal wellbeing. People younger than 19 or aged 65 and above may not use this version. These age limits are product eligibility rules, not a medical finding that people outside the range cannot manage nutrition. We check your age from the date of birth you give us.
You are responsible for keeping access to your sign-in method secure and for everything that happens under your account. Please give accurate profile information, since your daily targets depend on it.
3. Excluded users and health conditions
You must not use PLATE if any of the following apply to you, whether or not a condition is controlled, unless the wording below expressly limits the exclusion:
You are pregnant, may be pregnant, are breastfeeding, or are recovering from childbirth with ongoing nutritional or medical needs.
You have diabetes of any type, including type 1, type 2 or gestational diabetes; prediabetes; recurrent hypoglycaemia; or another disorder requiring blood glucose management.
You have kidney disease, dialysis requirements, significant liver disease, heart failure, cardiovascular disease, hypertension, or a prescribed fluid, sodium, potassium, protein or energy restriction.
You have a current or previous eating disorder, compulsive calorie restriction or exercise, malnutrition, underweight, frailty, unexplained weight loss, or a condition for which weight reduction or calorie tracking is unsuitable.
You have cancer under treatment, a metabolic disorder, a thyroid or other endocrine disorder affecting nutrition, inflammatory bowel disease, coeliac disease, malabsorption, a serious food allergy, or another condition requiring a therapeutic diet.
You are recovering from major surgery, bariatric surgery, serious illness or injury, receive tube feeding or other medical nutrition, or take medication that requires dietary management or materially changes appetite, weight, glucose or fluid balance.
You have any other diagnosed or suspected illness, disability-related nutritional need or treatment that requires an individual eating plan, or a clinician has advised you against unsupervised dietary changes.
If uncertain, do not begin using PLATE until your eligibility is clear. A clinician’s permission does not override an express exclusion in these Terms. You must stop using PLATE if you later become ineligible. You can still contact support about your data or legal rights.
4. Health disclaimer
PLATE provides general information to help you make food choices. Calorie, macronutrient and fibre figures are estimates based on photos, food-composition data and the information you enter, and may differ from what you actually eat. Daily budgets use a published equation and your settings; they are not a measurement of your metabolism. Suggestions are optional and are not personalised medical or dietetic advice, and do not create a clinician–patient relationship. Do not skip necessary meals, pursue extreme restriction or compensate for a high day through fasting or excessive exercise. Always use your own judgement, check food labels where accuracy matters (for example with allergies), and seek professional advice for medical needs. Stop using PLATE and speak to a professional if tracking food affects your wellbeing, and seek urgent care for any urgent symptom.
5. Free access, trials and subscriptions
Some or all of PLATE may require a paid subscription (“PLATE Premium”). New accounts get a free trial. Each email address can use the free trial only once, including after an account is deleted and created again, and whichever sign-in method is used (Apple, Google or email code). When a free period or trial ends, continued access to paid features requires an active subscription. Before you buy, the app shows the price, billing period and what is included.
In the iPhone app, subscriptions are bought through your Apple ID with Apple’s in-app purchase. On our website, payments are processed by Razorpay. We never receive your full card details.
Your subscription renews automatically at the end of each billing period at the then-current price, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
If you start a subscription during a free trial, any unused part of the trial ends when the subscription starts, where the store’s rules say so. Trials bought through an app store convert to a paid subscription unless cancelled at least 24 hours before they end.
If we change the price, we will tell you in advance, and the change will apply from your next billing period. Where the law or your app store requires it, we will ask for your consent first.
6. Cancellation & refunds
You can cancel at any time. App Store: Settings → your name → Subscriptions. Website: Profile → Subscription in PLATE. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then. Deleting the app or your account does not cancel an App Store subscription; cancel it in your Apple settings. Refunds for App Store purchases are handled by Apple under its policies. For website purchases, contact us at admin@klyra.co.in. This does not affect any refund rights you have under consumer law.
7. Your content
You own the photos, logs and other content you add to PLATE (“Your Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, process and display Your Content only as needed to operate and provide the Service to you. If you opt in to help improve PLATE, you also allow us to use de-identified Your Content to improve our food recognition and suggestions; you can withdraw at any time. You confirm you have the right to upload Your Content and that it does not infringe anyone else’s rights.
8. Acceptable use
You agree not to: upload unlawful, offensive or infringing content, or images of other people without their permission; reverse engineer, scrape, copy or resell the Service, its models or its data; interfere with or disrupt the Service, or try to get around security or subscription controls; use the Service to build a competing product, or for any unlawful purpose.
9. Our intellectual property
The Service, including its software, design, food database, models and the PLATE name and logo, belongs to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these Terms. If you send us feedback, we may use it freely.
10. App store terms
If you download PLATE from the Apple App Store or Google Play, you also agree to that store’s terms. These Terms are between you and us, not Apple or Google, who are not responsible for the Service or its support. Apple has no obligation to provide maintenance or support, and, to the extent permitted by law, no warranty obligation. Apple is not responsible for any claims relating to the app, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Termination
You can stop using PLATE and delete your account at any time in the app. We may suspend or end your access if you seriously or repeatedly break these Terms, if you are no longer eligible, or if required by law. Where reasonable, we will give you notice first. Sections that by their nature should survive (such as 7, 9 and 12–15) continue after termination.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We do not guarantee that estimates will be accurate, that you will reach any weight or health outcome, or that the Service will be uninterrupted or error-free. Nothing in these Terms excludes any rights you have under consumer protection laws that cannot be excluded.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
14. Indemnity
To the extent permitted by law, you agree to compensate us for claims and costs arising from Your Content or from your breach of these Terms.
15. Governing law, complaints & disputes
These Terms are governed by the laws of India, and disputes will be resolved in the courts of Bangalore, Karnataka. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may approach the consumer forums and courts available to you. Before starting formal proceedings, please contact our Grievance Officer so we can try to resolve the issue: Paul Antony, admin@klyra.co.in. We acknowledge complaints promptly and aim to resolve them within the time required by law.
16. Changes to these Terms
We may update these Terms to reflect changes to the Service or the law. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, and the app will ask you to review and accept the updated Terms. If you don’t agree, you can cancel your subscription and stop using the Service.
